1. About These Terms
These terms of use ("Terms") govern your access to and use of the Advisa platform, website, and related services ("Platform") operated by Advisa Pty Ltd ("Advisa", "we", "us", "our").
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Eligibility
The Platform is designed for use by Australian financial advisers, authorised representatives, and advisory firms operating under an Australian Financial Services Licence (AFSL). By using the Platform, you represent that:
- You are at least 18 years of age
- You are authorised to act on behalf of the firm registering for the Platform
- You will use the Platform in compliance with all applicable Australian laws and regulations, including the Corporations Act 2001 (Cth) and the Privacy Act 1988 (Cth)
3. Account Registration and Security
- You must provide accurate and complete information when creating an account and keep it up to date
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activity that occurs under your account, including actions taken by team members you invite
- You must notify us immediately at hello@advisa.app if you suspect any unauthorised access to your account
4. Use of the Platform
4.1 Permitted use
You may use the Platform to manage client relationships, advice workflows, compliance obligations, communications, and related business operations for your financial advisory practice.
4.2 Prohibited conduct
You must not:
- Use the Platform for any unlawful purpose or in violation of any applicable regulation
- Attempt to gain unauthorised access to any part of the Platform, other accounts, or related systems
- Reverse engineer, decompile, or disassemble any part of the Platform
- Use the Platform to store, transmit, or distribute malicious code or content
- Resell, sublicence, or provide access to the Platform to third parties without our written consent
- Use automated tools to scrape, crawl, or extract data from the Platform
- Interfere with or disrupt the integrity or performance of the Platform
5. Your Data
5.1 Ownership
You retain all ownership rights to the data you enter into the Platform, including client records, documents, notes, and communications ("Your Data"). We do not claim any ownership over Your Data.
5.2 Licence to us
You grant us a limited, non-exclusive licence to host, store, process, and display Your Data solely to provide and improve the Platform services. This licence terminates when you delete Your Data or close your account.
5.3 Data portability
You may export Your Data at any time through the Platform's export features. Upon account closure, we will provide a reasonable period to export Your Data before deletion.
5.4 Privacy
Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms.
6. Client Data Responsibilities
As a financial adviser using the Platform to manage client information, you acknowledge that:
- You are responsible for obtaining any necessary consents from your clients before entering their personal information into the Platform
- You are responsible for the accuracy of client data you enter
- You must comply with your obligations under the Privacy Act 1988 (Cth), the Australian Privacy Principles, and any conditions of your AFSL when using the Platform to process client data
- Advisa acts as a data processor on your behalf — you remain the data controller for client information
7. Third-Party Integrations
The Platform allows you to connect third-party services (e.g., Google Workspace, Microsoft 365, Twilio) to enable email, calendar, and SMS functionality.
- Third-party integrations are subject to those providers' own terms and privacy policies
- We are not responsible for the availability, accuracy, or conduct of third-party services
- You may disconnect any integration at any time, which will revoke our access to the connected service
8. Communications Sent Through the Platform
When you use the Platform to send emails or SMS messages to your clients:
- You are solely responsible for the content of those communications
- You must comply with the Spam Act 2003 (Cth) and the Do Not Call Register Act 2006 (Cth) where applicable
- You must ensure you have appropriate consent to contact recipients
- SMS messages are sent via Twilio and may incur per-message charges as described in the Platform pricing
9. Fees and Payment
During the early access period, access to the Platform may be provided at no charge or at discounted rates. We will provide reasonable notice before introducing or changing fees.
- Paid features (such as SMS credits) are billed as described in the Platform
- Payments are processed by Stripe. By making a payment, you agree to Stripe's terms of service
- All fees are quoted in Australian dollars (AUD) and are inclusive of GST unless stated otherwise
10. Availability and Support
- We aim to maintain high availability but do not guarantee uninterrupted access to the Platform
- We may perform scheduled maintenance with reasonable advance notice
- We are not liable for any loss or damage arising from temporary unavailability of the Platform

11. Intellectual Property
All intellectual property rights in the Platform — including software, design, branding, logos, and documentation — are owned by Advisa Pty Ltd or its licensors.
Nothing in these Terms grants you any right to use the Advisa name, logo, or branding except as necessary to use the Platform for its intended purpose.
12. Limitation of Liability
To the maximum extent permitted by law:
- The Platform is provided "as is" without warranties of any kind, whether express or implied
- We do not warrant that the Platform will meet your specific requirements, be error-free, or operate without interruption
- The Platform does not constitute financial advice. We do not provide, endorse, or take responsibility for any financial advice generated, managed, or communicated through the Platform
- Our total liability for any claim arising from your use of the Platform is limited to the fees you have paid to us in the 12 months preceding the claim
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law that cannot be excluded or limited by contract.
13. Indemnification
You agree to indemnify and hold harmless Advisa, its directors, employees, and agents from any claims, losses, liabilities, and expenses (including legal fees) arising from:
- Your breach of these Terms
- Your use of the Platform
- The content of communications you send through the Platform
- Your breach of any applicable law or regulation
- Any claim by a third party related to Your Data
14. Suspension and Termination
- You may close your account at any time by contacting us at hello@advisa.app
- We may suspend or terminate your access if you breach these Terms, fail to pay applicable fees, or if we reasonably believe your use poses a risk to the Platform or other users
- Upon termination, your right to access the Platform ceases. We will retain Your Data for a reasonable period (up to 90 days) to allow export, after which it will be deleted in accordance with our Privacy Policy
15. Changes to These Terms
We may update these Terms from time to time. Where changes are material, we will notify you via email or in-platform notification at least 30 days before the changes take effect.
Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you may close your account.
16. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of New South Wales.
